These Terms of Service ("Terms") govern your access to and use of Chive ("Service"), operated by Swatland AS ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Chive, you confirm that you have the legal capacity to enter into a binding agreement in your jurisdiction. If you are using Chive on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Description of Service

Chive is a cloud-based sheet music library that allows individuals and ensembles to store, organise, and access their sheet music. Features include:

  • Personal and shared ensemble libraries
  • PDF upload and storage
  • Part management and organisation
  • Subscription-based storage plans

3. Account Registration

To use Chive, you must create an account with a valid email address. You are responsible for:

  • Keeping your login credentials confidential
  • All activity that occurs under your account
  • Notifying us promptly at help@chivescore.com if you suspect unauthorised access

We reserve the right to reject or terminate accounts at our discretion.

4. Acceptable Use

You agree not to use Chive to:

  • Violate any applicable laws or regulations
  • Upload, store, or share content that infringes the intellectual property rights of others
  • Attempt to gain unauthorised access to any part of the Service or its infrastructure
  • Interfere with or disrupt the Service or servers connected to the Service
  • Use automated means to scrape, crawl, or extract data from the Service without permission

5. Uploaded Content & Copyright

You are solely responsible for the content you upload to Chive.

By uploading content, you represent and warrant that:

  • You own the content, or have a lawful right (such as a valid licence or a purchased copy of a score) to store it for your personal or ensemble use
  • Your upload does not infringe any copyright, trademark, or other intellectual property right of any third party

Chive does not grant any right to distribute, publicly perform, or share uploaded content beyond the intended private library use. Sheet music is copyrighted material — do not upload files you do not have the right to store.

Takedown requests: If you believe content stored on Chive infringes your copyright, please send a written notice to help@chivescore.com including:

  1. Identification of the copyrighted work claimed to be infringed
  2. Identification of the infringing material and enough information to locate it
  3. Your contact information and a statement of good faith belief that the use is unauthorised

We will review all valid notices and remove infringing content promptly.

6. Subscription Plans & Billing

Chive offers free and paid subscription plans. Paid plans are billed on a recurring basis (monthly or annually) via Stripe.

  • Billing: You authorise us to charge your payment method on each billing cycle.
  • Price changes: We will notify you at least 30 days in advance of any price change. Continued use after the effective date constitutes acceptance of the new price.
  • No refunds: All payments are non-refundable. If you cancel your subscription, you will retain access to paid features until the end of your current billing period, after which your account will revert to the free plan.
  • Failed payments: If a payment fails, we may suspend access to paid features until payment is resolved.

7. Cancellation & Termination

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period.

We may suspend or terminate your account if:

  • You violate these Terms (including the copyright obligations in Section 5)
  • Your account is used for abusive, fraudulent, or illegal activity
  • We decide to discontinue the Service

Where termination is not due to a breach by you, we will provide at least 30 days' notice. Upon termination, your data will be retained for 30 days before permanent deletion, during which you may export your data on request.

8. Disclaimers & Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

  • The Service will be uninterrupted or error-free
  • Any data stored in the Service will not be lost

To the fullest extent permitted by applicable law, our total liability to you for any claim arising from or related to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

We are not liable for any indirect, incidental, consequential, or punitive damages, even if we have been advised of the possibility of such damages.

9. Privacy

Your use of Chive is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our data practices as described in the Privacy Policy.

10. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of Norway, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of Norway.

11. Changes to Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page and, for material changes, notify you by email or in-app notice at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
